Green list of waste: Commission adopts seven new entries, including e-waste, aluminium and metals from vehicles
Delegated act C(2026) 7390: BEU06–BEU12, EU49. Absent EP or Council objection, in force on the 20th day after publication. GC010, GC020 until 31.12.2026.
On 26 October 2026 the European Commission adopted Delegated Regulation C(2026) 7390 amending Annexes III, IIIA, IIIB and IV to Regulation (EU) 2024/1157 on shipments of waste. The green list gains seven new entries, including aluminium and steel waste from building, construction and demolition (BEU07), treated electrical and electronic waste (BEU09), permanent magnets (BEU10) and metal waste from end-of-life vehicles (BEU11). The act is subject to scrutiny by the European Parliament and the Council, has not been published and is not yet in force, while entries GC010 and GC020 apply only until 31 December 2026.

What changes
Until 31.12.2026
Non-hazardous electrical and electronic waste meeting the description of GC010 or GC020 is shipped within the Union subject to Art. 18; Basel entry Y49 does not apply to these shipments. Other such waste, not covered by another entry, is subject to notification and consent (Art. 4(2)(b)). Clean metal scrap may fall under B1010, and end-of-life motor vehicles containing neither liquids nor other hazardous components under B1250.
From 01.01.2027
Entries GC010 and GC020 no longer apply – as laid down in Regulation (EU) 2024/3230. From the entry into force of C(2026) 7390, if neither the EP nor the Council objects, this waste is classified under BEU09 (Art. 18), another entry in Annex III, IIIA or IIIB, or EU49 (notification and consent). Until then, entry Y49 applies, meaning the notification and consent procedure; in the event of an objection, Y49 remains with no end date. The wording of entries such as B1010 and B1115 does not change.
New and deleted entries annex to the act, points 1–5
Relevant to metals4
- BEU07Waste consisting mainly of aluminium, steel or both from building, construction and demolition activities, including door frames, window frames, curtain walls and other framing profiles; minimal amounts of coating, plastic, rubber and other materials or other metal components allowed if the aluminium or steel remains the dominant recoverable fraction
- BEU09Electrical and electronic waste after proper treatment (Art. 8(2) of Directive 2012/19/EU), with no hazardous properties: equipment, components such as printed circuit boards, sorted fractions from shredding or dismantling; components and fractions only where not covered by another entry in Annex III, IIIA or IIIB
- BEU10Solid, inert permanent magnets from waste electrical and electronic equipment, end-of-life wind turbines and related infrastructure, or end-of-life vehicles
- BEU11Metal waste from end-of-life vehicles treated in accordance with Articles 28 and 29 of Regulation (EU) 2026/1738; minimal amounts of other materials allowed if metal remains the dominant recoverable fraction
Notification and deletions3
- EU49Waste electrical and electronic equipment, waste components or waste from their processing, not covered by A1181 or BEU09 – Annex IV, notification and consent
- GC010Deleted: electrical assemblies consisting only of metals or alloys
- GC020Deleted: electronic scrap and reclaimed electronic components suitable for base and precious metal recovery
Other entries4
- BEU06Fibre-reinforced polymer composites destined for recycling
- BEU08Waste mattresses, dry-collected, destined for recycling
- BEU12Footwear, hats and belts, not mixed with hazardous waste
- IIIAMixtures of wastes under B3030 and under BEU12

From adoption to application
- Adoptionthe Commission adopted the act on 26.10.2026 and notifies it simultaneously to the EP and the CouncilArt. 80(5)
- Scrutiny by EP and Counciltwo months from notification; extended by two months at the initiative of the EP or the Council; shorter if both institutions inform the Commission that they will not objectArt. 80(6)
- Publicationpublication in the Official Journal; the act receives its regulation numberArt. 297(2) TFEU
- Entry into forceif neither the EP nor the Council objects: on the 20th day after publication; directly applicable, with no transitional provision; an objection means the act does not enter into forceArt. 2 of the act; Art. 80(6)
Conditions and open questions
- BEU09 requires proper treatment – at least removal of fluids and selective treatment under Annex VII to Directive 2012/19/EU – and no hazardous properties; for waste equipment, in none of its components.
- BEU07 and BEU11: the terms “minimal amounts” and “dominant recoverable fraction” carry no numerical threshold.
- BEU11 refers to Articles 28 and 29 of Regulation (EU) 2026/1738, applicable from 1.09.2028; the obligation in Art. 29(1) from 1.09.2029. The act does not settle whether the entry can be used earlier.
- EU49 covers waste “not covered by A1181 or BEU09”, without the Y49 proviso on other entries, while BEU09 (second and third indents) gives way to entries in Annexes III, IIIA and IIIB. The act does not expressly explain how EU49 relates to B1010 and B1115. Recital 7, the proviso in BEU09 and entry BEU10 point to a narrower reading of EU49; if the authorities disagree, notification and consent apply (Art. 29(4)).
- The act adds no mixtures involving BEU07, BEU09, BEU10 or BEU11 to Annex IIIA. A mixture of such waste with waste under another entry, e.g. B1010, is subject to notification and consent (Art. 4(2)(c)), unless it falls within the description of a single entry. Wastes kept separate within one shipment are not a mixture (Art. 3(1)).
- BEU07, BEU10 and BEU11 take effect only when the act enters into force. BEU07 and BEU11 allow minimal amounts of other materials, and recital 9 also speaks of specifying that Art. 18 applies. The act does not define how these entries relate to B1010; the choice of code matters for exports (Art. 44(2)(d)).
- The act contains no transitional provision for the period from 1.01.2027 until entry into force, or for shipments under way.
- Where the authorities of dispatch and destination disagree on classification, the shipment is subject to notification and consent (Art. 29(4)).

Timeline
- End of the public consultation (from 2.07.2025; 146 stakeholders)
- End of feedback on the draft on “Have your say” (from 18.08.2026; 110 replies)

Status at 30.10.2026
Register of delegated acts: status “adopted”, scrutiny phase, scrutiny period 2 months. No entry on an extension, an objection or an early statement by the EP and the Council. The act is unpublished and not yet in force.
Unchanged
Art. 18 obligations above 20 kg: Annex VII form, contract with the consignee, DIWASS. The green list does not cover waste classified as hazardous, or waste contaminated to a degree that increases the risk or prevents environmentally sound recovery (Art. 4(2)(d)–(e), Annex IIIB point 1).
Exports and imports
The new entries concern shipments within the Union; EU49 replaces Y49 only within the Union (Annex IV, Part I, point (g)). Y49 and A1181: export to countries to which the OECD Decision does not apply is prohibited (Art. 39(1)(a) and (c)); export to countries to which it applies, and import, require notification and consent. Annex IIIB waste: export to countries to which the OECD Decision applies requires notification and consent (Art. 44(2)(d)); export to other countries is prohibited from 21.05.2027, except to listed countries (Arts 40–41). The Commission notes that the facilitation should not lead to more exports from the EU.
Parallel act
C(2026) 7389 of the same date, based on Art. 29(6), sets a contamination threshold for B2020 glass waste: other wastes up to 10% of the weight of the consignment in total. C(2026) 7390 sets no such threshold for BEU07 and BEU11.
