## In brief

National implementing provisions for the EU waste shipment regime: the Chief Inspectorate of Environmental Protection (GIOŚ) as competent authority, permits, financial guarantee, illegal shipment and penalties. The text still refers to Regulation 1013/2006 – it has not been aligned with Regulation (EU) 2024/1157.

## Key obligations

- notifications and permits for the import, export and transit of waste are handled by GIOŚ (Art. 3(1), Art. 4)
- financial guarantee in the form of a bank guarantee, an insurance guarantee or a deposit (Art. 20(1)–(2))
- shipments from outside the EU only through designated border crossings (Art. 30(1))
- prohibition on imports of waste for disposal in operations D1–D12 and of mixed municipal waste (Art. 11, Art. 11b)
- in the case of illegal shipment GIOŚ imposes by decision an obligation to take back or manage the waste within up to 30 days (Art. 25(1))

## Penalties

WIOŚ fines: PLN 10,000–1,000,000 for illegal shipment (Art. 32(1)–(2)), PLN 10,000 for failure to comply with a decision (Art. 32(3)), PLN 5,000–200,000 for failures by the notifier and the consignee (Art. 33); petty offences – detention, fine (Art. 31)

- 21.05.2026: application of Regulation (EU) 2024/1157 without alignment of the Act

## Pending changes

Draft Act on transboundary shipments of waste (UC115, RCL 12407554) – will replace the 2007 Act; after the European Affairs Committee (17.09.2026), before adoption by the Council of Ministers.
