# Regulation of the Minister of Health – tests and measurements of harmful agents

## In brief

Specifies the frequency of measurements of airborne concentrations at workstations, including lead, arsenic, cadmium and nickel compounds, as well as requirements for laboratories and records.

## Key obligations

- measurements of a harmful agent no later than 30 days after the start of activity (§ 3)
- CMR and reprotoxic: every 6 months at >0.1–0.5 NDS, every 3 months at >0.5 NDS (§ 6(1))
- other chemical agents and dusts: every 2 years at >0.1–0.5 NDS, every year at >0.5 NDS (§ 4)
- measurements each time after a change in the process, equipment or working conditions (§ 14)
- measurements only by accredited laboratories (§ 15(1)); results retained for 3 years, register and record card (§§ 17–18)

## Penalties

Art. 283 § 1 of the Labour Code – fine of PLN 2,000 to 60,000

## Application

in force; from 28.07.2024 the frequency applicable to CMR also applies to reprotoxic substances (Dz.U. 2024 poz. 1110)
