# List of non-OECD countries permitted to import waste (draft)

Draft Commission Delegated Regulation establishing the list of non-OECD countries to which the export from the Union of certain non-hazardous waste for recovery is permitted (Art. 41 of Regulation (EU) 2024/1157)

## In brief

Delegated act specifying the non-OECD countries and types of waste (including metal scrap) whose export from the EU will remain permitted after 21.05.2027. Outside the list, exports of non-hazardous waste outside the OECD will be prohibited.

## Key obligations

- export to a listed country only to a facility holding a national permit for the recovery of the waste concerned (Art. 40(2)(a) of Regulation (EU) 2024/1157)
- prohibition on sending to interim operations unless subsequent recovery takes place in a listed country (Art. 40(2)(b) of Regulation (EU) 2024/1157)
- the list covers the country, the waste authorised for export and the national control procedures of the country of import (Art. 41(2) of Regulation (EU) 2024/1157)

export contrary to Art. 40 constitutes an infringement of Regulation (EU) 2024/1157 – national penalties (Art. 63)

the list is intended to allow exports outside the OECD from 21.05.2027 (Art. 40(2) of Regulation (EU) 2024/1157)
