## In brief

Installations for the production of NF metals from ore, concentrates or secondary raw materials (Annex I, point 4(b)) and open-cast mining > 25 ha (Annex I, point 19) require an EIA; smelting of NF metals – Annex II, point 4(d) (screening).

## Key obligations

- obtaining development consent after an environmental impact assessment has been carried out (Art. 2(1), Art. 4)
- preparation of an environmental impact assessment report (Art. 5(1))
- implementation of the mitigation and monitoring measures specified in the decision (Art. 8a(4))

## Competent authority

PL: Regional Directorate for Environmental Protection (RDOŚ), head of commune / mayor / city mayor (wójt/burmistrz/prezydent miasta), district head (starosta) (Art. 75 of the EIA Act (ustawa OOŚ))

## Penalties

The Directive requires national penalties; in PL, inter alia, suspension of the use of a facility by the Regional Inspectorate of Environmental Protection (WIOŚ) (Art. 365(2) POŚ).
